This places the onus on the person to provide documented proof that they are scripturally free to remarry. This protects the local elders from liability. A persons "word" is not enough.
It also encourages a person to commit fornication, then come forth and confess it, in order to free himself in the eyes of the elders. Many will be willing to commit scriptural sin and face the elder judicial committy and possible DF, just so they and get a civil remarriage that the elders will recognize. After they are good and attend all the meetings for a year they can be in good standing again!
