RESOLUTION 1089 By: Key
AS INTRODUCED


A Joint Resolution claiming sovereignty under the
Tenth Amendment to the Constitution of the United
States over certain powers; serving notice to the
federal government to cease and desist certain
mandates; and directing distribution.
WHEREAS, the Tenth Amendment to the Constitution of the United
States reads as follows:
"The powers not delegated to the United States by the
Constitution, nor prohibited by it to the States, are reserved to
the States respectively, or to the people."; and
WHEREAS, the Tenth Amendment defines the total scope of federal
power as being that specifically granted by the Constitution of the
United States and no more; and
WHEREAS, the scope of power defined by the Tenth Amendment means
that the federal government was created by the states specifically
to be an agent of the states; and

WHEREAS, today, in 2008, the states are demonstrably treated as
agents of the federal government; and
WHEREAS, many federal mandates are directly in violation of the
Tenth Amendment to the Constitution of the United States; and
WHEREAS, the United States Supreme Court has ruled in New York
v. United States, 112 S. Ct. 2408 (1992), that Congress may not
simply commandeer the legislative and regulatory processes of the
states; and
WHEREAS, a number of proposals from previous administrations and
some now pending from the present administration and from Congress
may further violate the Constitution of the United States.
NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES
AND THE SENATE OF THE 2ND SESSION OF THE 51ST OKLAHOMA LEGISLATURE:
THAT the State of Oklahoma hereby claims sovereignty under the
Tenth Amendment to the Constitution of the United States over all
powers not otherwise enumerated and granted to the federal
government by the Constitution of the United States.
THAT this serve as Notice and Demand to the federal government,
as our agent, to cease and desist, effective immediately, mandates
that are beyond the scope of these constitutionally delegated
powers.
THAT a copy of this resolution be distributed to the President
of the United States, the President of the United States Senate, the
Speaker of the United States House of Representatives, the Speaker

of the House and the President of the Senate of each state's
legislature of the United States of America, and each member of the
Oklahoma Congressional Delegation.

Hi, sis Willa! :hibye: It feels like, "Long time, no talk to." I'll try to become a more frequent 'frequenter' here at Ye Olde Cafe.

I'm certainly no Constitutional barrister, but, ...

Essentially, the Bill says for the Federal government to "Cease and Desist" from overstepping their legitimate Constitutionally-granted authority. When they do "overstep" (which is only all the time), they are thereby trampling on the authority reserved to the States themselves. The original vision of the founding fathers of the USA (States' Rights Advocates, one and all) was for the federal government to be the servant to the states; not lord and master over them.

Thanks for the explanation. Hmmm... so - what event(s) precipitated this move? What have the Feds been doing in Oklahoma that's so reprehensible that they had to pass a House resolution on the matter?

Well, to say I am stunned would be putting it mildly. That this bit of information has not received one iota of coverage from even the conservative pundits is amazing. I'm still researching. But even on AOL today they had a poll asking whether you thought Bush would attack Iran before leaving office. Would he do such a thing for the sake of his legacy? This of course would create a declared state of war and cancel any chances that (B)Iraq Hussein Obama would have of becoming the next Pres. (is that a joke that the next pres could have a name like that?) And the fact that Bush declared a "State of Emergency" last month, giving him power to do anything he'd care to by virtue of Executive Order, may have had something to do with it as well. Who knows, but we could be seeing the beginning of the end of the US as we know it. Of course Israel will be alone at some point without protectors, surrounded by enemies when God steps in. As for Oklahoma, I guess we'll have to see whether they enforce this.

Hey brother freyd! :) I cannot disagree with anything you have said here. I don't think it is so much a question of "Why Oklahoma?" My sense is that Oklahoma is simply sending a message that it is OK to -- not only have these thoughts about the role of the federal government, -- but to act on them as well. I believe there is a groundswell of grassroots opinion in many states, -- especially those west of the Mississippi River, -- for exactly this type of thing (secession).

Personally, I have never lost touch with the thought that the Bush administration might orchestrate another 'national emergency' between now and November, whereby he could invoke full martial law and "legally" not leave office. And, as far as his "executive powers," he already has all he would ever need under FEMA.

It certainly appears to be a potentially-interesting few months ahead of us.

How do you feel these new talks with Iran on their enrichment of uranium fit in to the overall picture? It appears to the Brits the admin in States wants to avert war between Israel and Iran, which the Brits feel will probably come during the 'mayhem' when the States changes administrations.

I hope the latest man in the UK has more nous that are last man here who got the UK into the war with Iraq! Or more brave young men and women from the UK will come back in boxes, not to mention the ten of thousands of civilian co-lateral in Iran.

The consequences of all this madness will be an excuse for more planes into buildings and explosive rucksacks on London tube trains... What is the world coming to???? Yep, I know the answer.

I always wondered about this one - because that building was blasted in half! Then when they went out to the farm to gather all the 'evidence' - I forget the other guy's name (Terry?) - there really wasn't much to gather. . .
It baffles me how 'they' can rally a crime - to hide evidence - and convict before it will ever get the chance to really be investigated - because by then - the evidence had been destroyed, and they've convicted their idiot. . .

Oklahoma Recalls Bill That Would Have Facilitated NAFTA Superhighway

The Oklahoma State Senate voted to recall a bill that would have further facilitated plans for the NAFTA Superhighway to run through the state. There were fears that parts of Bill 1507, which dealt with Foreign Trade Zones, were tied to the superhighway which is to extend from Mexico to Canada. There were also concerns that this would lead to private property seizures through eminent domain. This is already taking place in parts of rural Texas with the construction of the Trans Texas Corridor (TTC), which is to be the first leg of this superhighway infrastructure.

Some have argued that Bill 1507 would have allowed for the creation of foreign owned smart ports. This would have allowed for imported goods to pass through the U.S./Mexican border without going through customs until Oklahoma . This follows in the same line as other proposed inland ports, such as the one in Kansas City. The NAFTA Superhighway will be a borderless open transportation system that will further facilitate the flow of cheap goods from China. Oklahoma has already passed legislation to stop the TTC from coming through the state.

The NAFTA Superhighway is the necessary infrastructure needed for the creation of a North American Union. It will serve as a highway for cheap Chinese goods and cheap labor from Mexico and Latin America. It will untimely benefit multinational corporations, who view borders as barriers to trade and greater profits. Last year, Rep. Virgil Goode, R-Va., introduced a House resolution that stated congressional opposition to the construction of a superhighway or entry into North American Union.

On Friday, July 10th, Alaska Governor Sarah Palin signed House Joint Resolution 27 (HJR27), sponsored by State Rep. Mike Kelly. The resolution “claims sovereignty for the state under the Tenth Amendment to the Constitution of the United States over all powers not otherwise enumerated and granted to the federal government by the Constitution of the United States.”

The House passed the resolution by a vote of 37-0 (3 not voting) and the Senate passed it by a vote of 40-0.

Six other states have had both houses of their legislature pass similar resolutions - Tennessee, Idaho, North Dakota, South Dakota, Oklahoma and Louisiana - Alaska joins Tennessee as the second to have such a resolution signed by the Governor.

A GROWING MOVEMENT

Passage of this resolution appears to be part of what is now a growing state-level resistance to the federal government on various levels. Similar 10th Amendment resolutions have been introduced in 37 states around the country, and various states are considering single-issue legislation in direct contravention to federal laws.

Most recently, the Arizona Legislature passed a measure for public approval on the 2010 state ballot that would give Arizona voters the opportunity to nullify, or opt out, of any potential national health care legislation.

Since 2007, more than two dozen states have passed legislation refusing to implement the Real ID act of 2005. In response, the federal government has recently announced that they want to “repeal and replace” the law due to a rebellion by states.

Pending legislation in states around the country also includes preventing state law enforcement officials from enforcing federal laws, refusing federal gun regulations, refusing to send a state’s national guard to any duty other than what the constitution authorizes, legalizing marijuana for various purposes and more.

Could be that state governments already feel they are being regulated enough by the Fed. This article points out they already pay 40% of medicaid costs and the Obama health care plan will certainly cost them more without their say so.

With a majority on the dems side in congress, I think states are getting nervous they will be able to pass anything they want without real debate. Tax payers and states will foot the bill as the Fed basically does not generate money, just spends it like crazy.
Texas Sends Rangers to Mexican Border

HOUSTON (Sept. 11) — Special teams of Texas Rangers will be deployed to the Texas-Mexico border to deal with increasing violence because the federal government has failed to address growing problems there, Gov. Rick Perry said Thursday. "It is an expansive effort with the Rangers playing a more high-profile role than they've ever played before," Perry said of the Department of Public Safety's elite investigative unit. The forces, dubbed "Ranger recon" teams, are the latest effort "to fill the gap that's been left by the federal government's ongoing failure to adequately secure our international border with Mexico," he said.

The governor early this year asked Homeland Security Secretary Janet Napolitano for 1,000 National Guard troops and renewed his call last month in a letter to President Barack Obama. The request is bogged down over who will pay for the troops and how they will be deployed.
Perry's announcement Thursday comes amid increasing border violence, particularly in El Paso, mostly involving people with ties to Mexican drug gangs...........
